S.Byambatsogt: We will work for an independent and fair judiciary, and we will support it
In connection with the implementation of the revised version of the Law on Courts of Mongolia on March 1, the Parliament will openly nominate and select non-judicial members of the General Council and the Judicial Disciplinary Committee through an appointment hearing. The draft resolution of the Standing Committee on the establishment of the Working Group to organize the tender was discussed at today’s meeting of the Standing Committee on Legal Affairs, and S. Byambatsogt, Member of Parliament and Chairman of the PFPA, was appointed as the working group leader.
At the beginning of the meeting, the Speaker of the Parliament issued an order appointing S. Byambatsogt, Chairman of the Standing Committee on Legal Affairs, as the leader of the working group. Members spoke on the issue.
MP J.Sukhbaatar: I support the proposal chaired by the Chairman of the Standing Committee on Legal Affairs. Other members openly and secretly sought to lead the working group. S. Byambatsogt, Chairman of the Standing Committee on Legal Affairs, has led the work on amending the Constitution, the Law on Judicial Reform, and the Standing Committee on Legal Affairs. In order to uphold the rule of law, the person in charge should lead the working group.
MP D.Ganbat: Who is not the chairman of the Standing Committee on Legal Affairs? In 2014-2016, I was the Chairman of the Standing Committee on Legal Affairs. At that time, I was in charge of the whole working group. Because you take responsibility later.
S.Byambatsogt, Member of Parliament and Chairman of the PFPA: The General Council of the Judiciary approved the establishment of an independent and fair judiciary as the Secretary of the Working Group on Amendments to the Constitution and the establishment of a Disciplinary Committee. Second, during his tenure as chairman of the Standing Committee on Legal Affairs, he enacted the Law on the Judiciary, which provides for a fair and independent judiciary. We will work to see the end of the work we have started, to have an independent and fair judiciary, and we will work behind it.
MP B.Enkhbayar: The law provides for the establishment of a working group with 11 members. There are no MPs on the NHRCM. These people are not accountable for their decisions. The decision of the working group shall be formalized in the standing committee. As a result, the Parliament will be politically responsible.
Therefore, one member of the Parliament should be in the working group. He asked who would appoint the leader of the working group and said that the only person to represent the Parliament would be the Speaker. Therefore, the law stipulates that the working group should be chaired by a person appointed by the Speaker of the Parliament. The Standing Committee will not vote on whether to support the Speaker’s decree. Voting will not take place because the law provides for direct appointments. Now it is stated that the order of the Speaker of the Parliament will be presented at the meeting of the Standing Committee.
